How to report copyright infringement on RideIndex, and how to respond if your content was removed.

RideIndex lets riders upload and store their own content — activity files, routes, photos, and club branding. We respect copyright and respond to valid notices under the Digital Millennium Copyright Act (17 U.S.C. § 512).

Submitting a notice of infringement

To be effective, your written notice must include all of the following:

  1. Your physical or electronic signature, as the owner of an exclusive right that is allegedly infringed, or a person authorized to act on their behalf.
  2. Identification of the copyrighted work you claim has been infringed — or, if multiple works are covered by a single notice, a representative list of them.
  3. Identification of the material you claim is infringing and that you want removed, with enough detail for us to locate it — a direct URL is best.
  4. Your name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.

Please be careful. Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees. If you are not sure whether the material infringes your copyright, talk to a lawyer first.

What happens next

  • If your notice is valid, we will remove or disable access to the material within a reasonable time.
  • We will make a good faith effort to notify the person who uploaded it, and provide them a copy of the notice.
  • If a notice is incomplete, we may contact you for the missing information before acting on it.

Counter-notification

If your content was removed and you believe that was a mistake or a misidentification, you may send a counter-notification to the agent above. It must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed, and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located — or, if your address is outside the United States, any judicial district in which RideIndex may be found — and that you will accept service of process from the person who filed the original notice, or their agent.

If we receive a valid counter-notification, we may restore the material in 10 to 14 business days, unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who are repeat infringers. We may also limit or terminate access at any time for any user who we believe is infringing the copyrights of others, whether or not a formal notice has been received.
